CBD’s legal status around the world

The uncertainty around CBD’s legal status around the world is mainly due to the presence of THC, the psychoactive component of marijuana. Due to the 2018 Farm Bill, CBD products derived from a hemp plant containing less than 0.3 percent THC are now considered legal in the United States.

Several Latin American countries have relaxed their laws on CBD. EU law permits CBD products with no more than 0.2 percent THC.

There is still some confusion regarding the legal status of CBD around the world despite the supplement’s increasing popularity. Most of this uncertainty revolves around CBD’s relationship with THC, the psychoactive component of marijuana that is still banned in many countries. However, as laws trend towards the decriminalization and legalization of marijuana, that has been paired with an open stance towards CBD, too.

Legal Status of CBD in North America and South America

The 2018 Farm Bill is the most significant legislation regarding the legal status of CBD within the United States of America. This bill reclassified hemp, which is like marijuana but contains far less THC. Instead of being a controlled substance, hemp is now considered an agricultural product. This applies to any hemp plant that contains less than 0.3 percent THC. So, if the CBD products were derived from a hemp plant containing less than that amount of THC, they are now considered legal to buy.

Recently, several Latin American countries relaxed laws around CBD, too. Mexico, for instance, has allowed CBD used for medical purposes since 2015. In 2018, they push forward with the legalization of CBD due to a court ruling. Despite Brazil’s notorious opposing cannabis legalization, the federal government okayed CBD for therapeutic uses in 2014 and have only added more instances of CBD use since.

Legal Status of CBD in the European Union

EU law permits CBD products with no more than 0.2 percent THC. This applies across Europe except for a few notable exceptions like Croatia and Slovenia. Both countries continue their legacy of outright banning all cannabis products, including CBD.

Other European countries, though, still hold legislation that may differ slightly from the EU’s stance. CBD is considered medicine in Finland. So, while it is legal, it does require a doctor’s prescription to purchase. Even still, countries like Austria and Ireland differ from EU general law due to their slightly higher allowed amount of THC in CBD oil products.
